The presenters will consider some of the key strategies that you can adopt in order to help protect your clients’ asset base with a focus on major changes in their circumstances through either a spousal breakup or death. This seminar will discuss the practical and strategic advice for the partner who has control of the majority of assets - with a main focus on the issues as between partners to a relationship, not claims by children.

This seminar will include:

  • Advice on what to do when your clients have a prenuptial agreement and the effect this can have on contracting out under section 182 of the Family Proceedings Act
  • Practical issues for when dealing with a family trust; should the controlling partner consider removing their partner as beneficiary and/or trustee
  • A discussion of the rights of children as beneficiaries under section 182 of the FPA
  • Instances of how trusts can be used to avoid estate claims
  • How to use a contracting out agreement to stipulate what each partner’s entitlement on death will be and how this can be used to avoid dispute
  • Steps to avoid having your client’s assets frozen upon death.

Deborah was admitted to the bar in 1983, commenced practice as a barrister sole in 1989 and took silk in 2007. She specialises in relationship property law, trusts, estates and fiduciary duties. Deborah’s work in this area includes complex cases frequently involving international property. She is also experienced at representing clients in mediations. Deborah is the co-author of the best-selling handbook on domestic property and estate law For Richer For Poorer and also a co-author of the New Zealand Master Trusts Guide. She was counsel for Mrs Clayton in Clayton v Clayton in the Court of Appeal and Supreme Court.

Sharon is a Senior Associate at Turner Hopkins in Auckland. Sharon’s principal areas of practice involve dealing with relationship property, trust and estate disputes. She provides specialist advice as to the best manner in which to protect assets when entering into a relationship and division and protection of assets as a result of separation. Sharon has been interviewed on a number of occasions by various media outlets to comment on topical family law related issues. Her experience in a diverse range of family law matters means she is able to appreciate family dynamics and provide pragmatic legal advice.
