From the Chair

Dear Colleagues

The theme for the 2017 NZLS CLE Trusts Conference “Trusts on Trial” mirrors the challenges and threats that face trustees and their advisers in 2017.

Recent publicised court decisions have caused lawyers and trustees to review the drafting of trust documents and administration of trusts.

Decisions unique to New Zealand, imposing constructive trusts on express trusts illustrate the extent to which judges in this country will overlook traditional trust principles in the interests of practical justice.

At the same time the Trusts Bill has been circulated as an Exposure Draft. While largely a restatement of existing law, it will cause trustees to review their practices and traditional ways of doing things.

These developments make interesting times for trust lawyers and the programme for the 2017 conference reflects this. I encourage and invite you to join us in June of this year as we put Trusts on Trial for the 2017 NZLS CLE Trusts Conference.

Chair: Greg Kelly
