Most commercial contracts are transacted through agents, usually on both sides, and yet agency law is something of a mystery to most practitioners. Even the basics are not widely understood.

When the contractor is a trading trust, a partnership or a nominee there are issues which, if not understood at the time the contract is entered into, can have serious repercussions for those involved.
