The New Trial Committal Process and Disclosure Regime

The Criminal Disclosure Act 2008 and the Summary Proceedings Amendment Act (No 2) 2008 were split from the wide ranging Criminal Procedure Bill, which amended a number of criminal law statutes with the objectives of maximising efficiency and fairness in the Criminal Justice system. Many experienced practitioners have voiced the opinion that, at least as far as the new committal procedure is concerned, the exact opposite will be achieved. Whether this is so remains to be seen. The proof of the pudding is in the eating. Whatever one feels about it however, one thing is certain, the Summary Proceedings Amendment Act has been passed and the new regime is very soon to be upon us.The purpose of this seminar is to bring practitioners thoroughly up to speed with the changes brought about by these two Acts and to provide guidance on how things are intended to work in practise.
