Interpretation of Statutes and Contracts
Author(s): John Burrows
Published: 9 June, 2008 Pages: 45 IntroductionWe often look at the various sorts of legal documents – contracts, statutes, wills, bylaws, etc – as being different creatures. The “rules” for interpreting each of them are usually considered in isolation. But more recently it has been recognised that these are common themes in the interpretation of all sorts of legal documents, and that even where there are differences, comparison between them can lead to insights. The purpose of this seminar is to compare and discuss the interpretation of two of the most common and important sorts of document: statutes and contracts. There are commonalities, but there are also important differences. |
