Introduction
The Children Young Persons & their Families Act 1989 (the Act) is legislation passed to promote the well-being of children young persons and their families. It is a piece of legislation that lawyers often understand in general terms but a close knowledge of the specific provisions of the Act is required in order to ensure that you are able to competently represent your client. In addition to that knowledge, you must develop the ability to manage the complicated relationships and dynamic of a CYFS case. You will need a relationship of trust and confidence with your client and at the same time, a working relationship with the social worker involved in the case. You will need access to community agencies and services. You will need to be well versed in all aspects of advocacy – persuasion, negotiation, mediation, and court representation. You will need to know the rules of evidence.
This paper is designed to help lawyers who act for parents and caregivers of children when care and protection issues are raised. It is intended to be a practical resource to be applied through the various stages of your client’s involvement with Child Youth & Family Services and the court, in a care and protection case.
