There have been recent changes at the Overseas Investment Office that impact on applications submitted under the Overseas Investment Act 2005 and the approach that the Office takes to enforcement. This webinar will assist you in advising your clients on the submission of applications to the Office and its new enforcement strategy. It will also provide practical advice for preparing high quality applications that maximise your clients opportunities for successful results.
All applications received after 9 November 2016 are now being assessed under the Overseas Investment Office’s (the Office) new processes.

Additionally, new application templates are being developed in order to help ensure that applicants take the correct approach from the begining of the process. The Office has also developed an enforcement strategy which prioritises actions aimed at ensuring investors comply with the Overseas Investment Act 2005 and deliver on their commitments.

Introduction

As a result of last year’s increase in application fees, the Overseas Investment Office (OIO) has increased its staff numbers and changes have been made to the applications process and the enforcement team.

An application for consent under the Overseas Investment Act 2005 (Act) can be far from
straightforward, especially if the overseas investor’s advisors are unclear about the process or what is needed from them and their client.

The first part of this paper looks at the changes to the applications process, new forms and technical resources.

The second part considers the OIO’s enforcement function and strategic priorities.
