Transparency and efficiency impact on modern expectations of exercises of legal power and advice on legal topics. The phrase “conflict of interest” is often deployed. What “interests”? What “conflicts”? What else is relevant? These questions are unavoidable in judicial or tribunal decisions, central or local government decisions, private sector corporate decisions, and in legal advice.
The costs of getting a decision, or advice, wrong on the topic of conflicts can be very high. No one really wants to be caught up in issues such as arose in the Tower, Lab Tests or Saxmere disputes. This course will help lawyers to recognise and understand these issues through exploration of three areas:
Current developments in best practice and judicial approaches to conflicts of interest in various circumstances
